CityDeputies failed to report illegal immigrant’s status, lawsuit says

OREGON CITY — The family of a Texas girl murdered in 2007 is suing Clackamas County, claiming law enforcement officers knew her killer illegally entered the United States and failed to report him to immigration authorities.

The estate of Dani Countryman is seeking $3.5 million in damages, according to the Clackamas County Circuit Court filing.

Countryman, 15, died during a sexual assault July 28, 2007, after an all-night party at an Oak Grove apartment complex. She was in Oregon visiting relatives.

Edward S. McGlone III, assistant Clackamas County counsel, declined to comment on the complaint.

Alejandro Emeterio “Alex” Rivera Gamboa, 26, was sentenced to life in prison, with the possibility of parole after 35 years. He attempted to subdue Countryman, fatally choking her, as his cousin, Gilberto Javier “Gabe” Arellano Gamboa, tried to rape her.

Arellano Gamboa, 25, was sentenced to five years, 10 months in prison.

Both men were in the country illegally and will be deported to Mexico after serving their sentences.

The lawsuit claims that a Clackamas County probation officer and unnamed sheriff’s office employees failed to report Rivera Gamboa to the Immigration and Customs Enforcement.

The Oregonian reported that Rivera Gamboa pleaded guilty to drunken driving in November 2006. He signed a plea agreement that stated he was not a U.S. citizen and was released without anyone in the criminal justice system notifying immigration authorities.

UPDATE:
Samantha Haupt returned home last night at about 11:00 PM uninjured. The two suspects are still being sought for their involvement in the assault of Samantha’s friend. The matter remains under investigation.

 (following is the comment from someone stating they are the older sister of the girl assaulted by the two nasty illegal mexicans.)

 I am the older sister of the second victim in the assault and kidnapping story involving Samantha. Henrike Luna-Castillo, beat my sister almost half to dealth. She however was lucky enough to get away. She since has had to eat from a staw!  These men need to be caught! In 2002 Henrike Luna-Castillo, was charged with a similar case where he almost killed another woman. Please if anyone see’s these brother’s call police.


Once again the Salem Police and the Media are tiptoeing around the Illegal Criminal Hispanic Surge in Oregon. This should be an Amber Alert or at least identify that it is two fat mexicans who may leave the state , rather then act as though Samantha left of her own free will. White women are worth nothing these days. If the public new that two fat ugly mexican illegals kidnapped a white girl they might question the invasion.

The Salem Police Department is asking for the public’s help in locating a missing female and two male suspects following an assault that occurred in the early morning hours last Saturday, October 31st. The trio was with a fourth female who managed to escape from the two males after being physically assaulted by one of them. She reported that her female friend was also physically assaulted by one of the males.

The missing female has been identified as Samantha Haupt, 20 years of age of Salem. She is described as a White female, 5’4″ tall, 115 pound, with blonde hair and hazel eyes. She was last observed with the two males.

The suspects have been identified as Henrike Luna-Castillo, 35 years of age of Salem; and Alfredo Rodriguez-Lopez, 36 years of age from Salem. Luna is described as a Hispanic male 5’9″ tall, 300 pounds, with black hair and brown eyes. Rodriguez is described as a Hispanic male, 5’8″ tall, 210 pounds, with black hair and brown eyes. Luna may be operating a 2000 Volkswagon Passat 4dr., blue in color, with Oregon license plate 287BLG. All four people involved in this incident were acquainted with each other prior to this weekend.

Police would like to speak with Samantha Haupt to ensure her safety. Anyone with information regarding this incident is asked to call Salem Police at (503)588-6123.

Dani Countryman was 15 and on vacation from her home in Texas when she was murdered in July of 2007. She was found dead after attending a party with her sister.
Investigators believe someone stepped on her throat and strangled her as they tried to rape her.
Alejandro Rivera Gamboa and his cousin, Gilberto Javier Arellano Gamboa, were already charged with aggravated murder in Countryman’s death. The two also face charges of attempted rape and attempted sex-abuse. As for the two cousins, they were arrested in 2007 and were awaiting trial in jail.
Investigators said Countryman scratched the men who killed her, providing valuable DNA evidence under her fingernails that led to two arrests. Forensic scientists from Oregon State Police said a shoe seized from one of the suspects, Alejandro, 24, had blood on it. The pattern of the shoe was also consistent with the imprint on Countryman’s chest, according to investigators

Kinda makes you want to rent an apartment in Oregon with all the mexicans living  in them, how come no lawyer has pursued legal action against the Apartment complex that hired them and rented to them? Are there no noble lawyers in Oregon>

 

 

 

OREGON CITY — Two men involved in the strangulation death of a Texas teen in the summer of 2007 in a Milwaukie apartment were sentenced Tuesday in Clackamas County circuit court.

Dani Countryman was a 15-year-old girl who came to live with her sister Ashley in the summer of 2007. She was found strangled by her sister the morning after a party in the Balboa apartments.

 

Gilberto was sentenced to 70 months in prison for attempted first-degree sex abuse and for hindering prosecution, according to Clackamas County prosecutor Chris Owen.

His cousin, Alejandro Rivera Gamboa, is expected to serve life in prison for aggravated murder and abuse of a corpse. He may have a parole hearing after 35 years.

Ashley Countryman held a party on July 27. Dani was scheduled to return to Texas the following day. The morning of the 28th, Ashley found Dani’s body on the floor of a first-floor apartment, partly covered with a blanket. She called police and deputies arrived about 8:30 a.m.

 

Later that day, police arrested Rivera Gamboa for a probation violation on a drunk driving charge. Allejandro Gamboa was arrested Aug. 6 at his unit of the Balboa apartments, a few doors down from where Dani was strangled.

Both men initially were accused of aggravated murder. Attempted rape charges and sex abuse charges were added later. Both men also told police they knowingly entered the country illegally. Arellano Gamboa had no prior record. Local and federal police never pursued deportation for Rivera Gamboa despite the drunk driving conviction.

Court records showed Rivera Gamboa admitted to stepping on the girl’s throat and holding her down and that the two tried to sexually assault her. Police said 15-year-old Dani Countryman tired to fight off the cousins.

Clackamas County investigators said Countryman scratched the men who killed her, providing valuable DNA evidence under her fingernails that led to two arrests.

Forensic scientists from Oregon State Police said a shoe seized from Alejandro,had blood on it. The pattern of the shoe was also consistent with the imprint on Countryman’s chest, according to investigators
