H1-B Temporary Workers

An H-1B allows you to come to the United States to work for up to 6 years in a “specialty occupation” for a designated employer. A “specialty occupation” is defined as an occupation which requires at least a bachelor’s degree in a specific field. Persons subject to the 212(e) two-year residence requirement are not eligible for a H-1B until the two-year requirement is met or a wavier of the requirement is obtained.

Concurrent Employment

It is possible to have multiple or concurrent employers. However, each employer is required to have an approved H-1B petition for you.

Portability Provisions

You may begin employment with a new employer upon the filing of the H-1B petition without having to wait for approval of the petition. In order to be eligible for the portability provisions you must meet the following requirements:

  • Be in H-1B status
  • Be in lawful nonimmigrant status
  • Have only engaged in authorized employment
  • Your new employer must have submitted a non-frivolous petition before the expiration of your current authorized stay

H-1B Cap

H-1B visas are limited to 65,000 per fiscal year (Oct. 1st-Sept 30th). There are also an additional 20,000 H-1B visas available per fiscal year for those who have earned a master’s or higher degree from a U.S. institution of higher education. Some employers are exempt from the cap (e.g., institutions of higher education, etc.) OHSU is exempt from the H-1B cap as an institution of higher education.

Entering the United States in H-1B Status

When you arrive at the U.S. port of entry you must present the documents listed below to the immigration official:

  • A valid passport (unless you are exempt from the passport requirement)
  • A valid H-1B visa (unless you are exempt from the visa requirement, i.e. Canadian citizens)
  • Form I-797B- H-1B approval notice
  • A full copy of the H-1B petition submitted to DHS – you are not required to submit this to the immigration official at the time of entry but it is recommended that you carry it with you just in case the officer wants to look at it.
  • Form I-94

The immigration official will return the Form I-94 and it should be marked H-1B (H-4 for dependents) and have a period of validity which is the same as the expiration date on your H-1B approval notice (Form I-797B).

Travel

U.S. law requires that you carry your immigration paperwork on you at all times. It is highly recommended that you carry the following documents with you when you travel domestically or internationally:

  • A copy of your H-1B approval notice(I-797B) or the original if you are traveling internationally. You can borrow the I-797B for travel by contacting the Office of International Services.
  • A full copy of the H-1B petition submitted to DHS
  • A valid passport
  • A valid visa (if reentering from abroad, unless traveling to Canada or Mexico for less than 30 days)
  • A letter from the Office of International Services verifying your current status.
  • Your Form I-94(if reentering the United States from a trip abroad you will receive a new I-94, unless you are reentering from Canada or Mexico after a trip of less than 30 days)*Trips to Canada and Mexico — You may reenter the United States without a valid visa after a trip of less than 30 days to Canada or Mexico. In order to take advantage of this provision you must be maintaining valid H-1B status, have a valid passport (unless exempt from passport requirements), have a current H-1B approval notice (I-797B), and have a valid I-94. *Please be aware that if you travel to Canada or Mexico to apply for a new visa you will not be able to reenter the U.S. under the revalidation provisions stated above if your visa application is denied by the consulate for any reason.

*Citizens or nationals of Iraq, Iran, Syria, Libya, Sudan, North Korea and Cuba are also not eligible for the revalidation provisions and must have a valid visa to reenter the U.S. after a trip to Canada or Mexico.

*Anyone who has been an overstay under INA 222(g) is also not eligible for the revalidation provisions and must obtain a new visa in his/her home country to reenter the U.S.

New Airport Transit Visa Requirements for Countries in the European Union
France, Austria, Belgium, Denmark, Finland, France, Germany, Greece, Iceland, Italy, Luxembourg, Netherlands, Norway, Portugal, Spain and Sweden are now requiring that nationals from several countries including India obtain “airport transit visas” for connecting flights. If you are from one of the designated countries you are required to obtain the “airport transit visa” even if you will not be leaving the airport. There are exceptions for nationals from these countries who are US Permanent Residents. Dependents

Spouses or unmarried children(under 21 years of age) may accompany you to the United States or join you at a later date in the United States. Dependent family members will be given H-4 status. Nonimmigrants in H-4 status are NOT allowed to work in the United States. However, they may attend school either part-time or full-time. A dependent of a H-1B will need the following documents to apply for a H-4 visa:

PER CURIAM. 

The petitioner is a 52-year-old citizen of Guyana who came to the United States in 1983 under a non-immigrant visitor visa. He remained here after his visa expired and was served with a show cause order charging him with deportability for remaining in the United States longer than permitted. 8 U.S.C. § 1251(a)(2) (1988). 

Shortly after Singh arrived in the United States he went through a wedding ceremony with a woman he had known a short time. At his deportation hearing Singh claimed that although they were later divorced he had entered into the marriage with the purpose of establishing a lasting relationship as husband and wife. His former wife testified at the hearing, however, and completely repudiated Singh’s version, stating that she had married Singh only to help him stay in the United States. Furthermore, the former wife’s roommate testified that there was no marriage and that the petitioner and the woman never lived together. 

Singh conceded deportability but sought political asylum, an order withholding deportation, or a voluntary departure order. Both the immigration judge and the Board of Immigration Appeals (BIA) denied Singh’s application on all three grounds and ordered him deported. 

I. 

A. 

Singh based his political asylum claim on his assertion that the government of Guyana discriminates against Guyanese who are of Indian origin and are Hindus. He contended that the Afro-Guyanese who govern the country tend to discriminate politically against Hindus in terms of government jobs, ownership of property, and participation in elections. To establish the fact that he was a target of discrimination Singh testified about vandalization of a Hindu temple and various transgressions against Hindus, which he claimed the Guyana police ignored. He relied on one specific incident where his brother-in-law was murdered during a Hindu religious celebration. 

Singh also claimed that he was a leader of an opposition political party in Guyana and that members of the party were treated “like dogs.” 

B. 

The immigration judge denied Singh’s claim of eligibility for political asylum after finding that there was no evidence that the petitioner was singled out for persecution or that the government of Guyana was behind the violent acts against Hindus. Furthermore, in light of the petitioner’s false claims about his marriage, the immigration judge found that the petitioner was not a credible witness on any issue. This lack of credibility led the judge to deny the request for voluntary departure. 

The BIA affirmed the immigration judge’s decision, finding that the evidence failed to show “that a reasonable person in [Singh’s] circumstances would fear persecution on account of race, religion, nationality, membership in a particular social group, or political opinion . . . .” Furthermore, the BIA found that Singh gave false testimony under oath and was statutorily ineligible for voluntary departure under 8 U.S.C. § 1101(f)(6). 

On appeal the petitioner repeats the arguments that he made in his brief before the BIA. Finding that the decision of the BIA is supported by substantial evidence and that the Board followed controlling law, we affirm. 

II. 

The Refugee Act of 1980 added a new section 208(a) to the Immigration and Naturalization Act of 1952. 8 U.S.C. § 1158(a) (1988); INS v. Cardoza-Fonseca, 480 U.S. 421, 427, 94 L. Ed. 2d 434, 107 S. Ct. 1207 (1987). This section authorizes the Attorney General of the United States, in her discretion, to grant political asylum to a refugee who is unable or unwilling to return to his country of origin “because of persecution or a well-founded fear of persecution on account of race, religion, nationality, membership in a particular social group, or political opinion.” Cardoza-Fonseca, 480 U.S. at 423 (quoting definition of “refugee” set forth in 8 U.S.C. § 1101(a)(42)(A)). 

In order to prove the existence of a well-founded fear of persecution, an applicant for asylum must demonstrate that a reasonable person in his position would fear persecution if he returned to his country of origin. Behzadpour v. United States, 946 F.2d 1351, 1352 (8th Cir. 1991). The reasonable fear must also be based on one or more of the five factors listed in § 1101(a)(42)(A). Id. Singh relies on at least two of these factors, religion and political opinion. 

To cause reversal of a BIA decision denying asylum an applicant must demonstrate that “the evidence presented was so compelling that no reasonable factfinder could fail to find the requisite fear of persecution.” Alsheweikh v. INS, 990 F.2d 1025, 1027 (8th Cir. 1993) (quoting INS v. Elias-Zacarias, 502 U.S. , 112 S. Ct. 812, 817, 117 L. Ed. 2d 38 (1992). Although Singh presented some evidence from which the immigration judge and BIA could have found both an objective and a subjective well-founded fear of persecution, the evidence was clearly not sufficiently compelling to require reversal. With respect to the incident in which Singh’s brother-in-law died, the record supports a finding that the killing occurred during a robbery and that it was not part of a pattern of persecution. Furthermore, Singh presented no evidence that he was ever singled out for persecution because of his religious or political activities. The fact that Hindu citizens of Guyana are treated shabbily by the authorities is not enough. 

III. 

Singh also sought an order withholding deportation under 8 U.S.C. § 1253(h)(1), which provides that “the Attorney General shall not deport or return any alien . . . to a country if the Attorney General determines that such alien’s life or freedom would be threatened in such country on account of race, religion, nationality, membership in a particular social group, or political opinion.” Although the five qualifying grounds are the same as for asylum, different standards apply. Refugee status alone does not qualify an alien for withholding of deportation under § 1253(h), and the well-founded fear standard does not apply. INS v. Stevic, 467 U.S. 407, 428, 81 L. Ed. 2d 321, 104 S. Ct. 2489 (1984). The standard for this non-discretionary relief is a “clear probability of persecution.” Id. at 430. Thus, the applicant must show that “it is more likely than not that the alien would be subject to persecution on one of the specified grounds.” Id. at 429-30. This court has held that inasmuch as “it is easier to prove a well-founded fear of persecution than a clear probability of persecution,” the finding that an applicant does not qualify for asylum necessarily leads to the conclusion that the alien is not entitled to have deportation withheld. Behzadpour, 946 F.2d at 1354. 

IV. 

The Attorney General may permit an alien under deportation proceedings to depart voluntarily at his own expense in lieu of deportation. To be eligible for this discretionary relief from involuntary deportation, the alien must establish that “he is, and has been, a person of good moral character for at least five years immediately preceding his application for voluntary departure . . . .” 8 U.S.C. § 1254(e)(1). By definition, however, a person cannot be found to be a person of good moral character who, within the required time, “has given false testimony for the purpose of obtaining any benefits” under the Immigration and Nationality Act. 8 U.S.C. § 1101(f)(6). As noted, Singh gave false testimony concerning his “marriage.” Thus, the immigration judge and the BIA correctly determined that Singh was not eligible for voluntary departure. 

The order of the BIA dismissing Singh’s appeal from the immigration judge’s order of deportation is affirmed.

Sen. Judd Gregg secretary of commerce is as bad as it gets. Obama might as
well have appointed Bill Gates. Gregg gets a failing grade of F on guest

I wanted to punch him in the face as I watched a 5 minute video of Sen.
Gregg at the Cato website (link below). Among other things he wants to
raise the number of H-1B visas to 150,000.

Greg parrots the industry line on H-1B. One of his favorites is to repeat
the claim by Bill Gates that every H-1B creates 5 jobs for Americans. Ron
Hira asked the right question for Computerworld:

The five-jobs-per-H-1B-worker claim, said Hira, “is so absurd that
Mr. Gregg should be laughed out of the room. This is the kind of
thoughtful leadership that Mr. Obama is bringing us?”

Ron Hira wrote a stinging article for EE Times where he said:

“Obama Administration has been in office just a few weeks now, but
we already know how it will address the offshoring of engineering
jobs. It will promote it.

Be sure to read the last part of Hira’s commentary because that’s the most
important.

Unfortunately Gregg isn’t the only bad appointee. Diana Farrell was
appointed by Obama for the National Economic Council and as deputy economic
adviser to the president. She has worked for the McKinsey Global Institute
for a long time. In 2004 Farrell said:

“People in the US are looking at it as a job issue. They are not
economists and therefore, they dont necessarily see the whole
picture. What’s going to happen is that offshoring is actually
going to benefit US businesses even more than India.”

Larry Summers and Ron Kirk are two other stinker appointments by Obama.
Summers will lead the president’s National Economic Council and Kirk will
be the chairperson. So, Obama is stacking his entire administration with
pro H-1B, pro free trade, and anti-worker dregs from industry and the
Clinton and Bush administrations.

Last night Lou Dobbs had an excellent report on Gregg and it is available
at the CNN site. Ron Hira appeared on Dobbs so he has really been hitting
the road to get the word out.

DOBBS: Well this may be what we’re going to see from the Obama
administration. That’s a shame, because it’s intellectual
dishonesty. It is absolute arrogance to continue to repeat the
policies of the past. Larry Summers, all of these folks very
capable people, that are absolutely part of the Rubin legacy.

It’s devastating what’s happening here. The millions of people,
working men and women who worked and supported and voted for
Barack Obama for change in the direction of trade policies have
to be extraordinarily disappointed, but fundamentally, if there
is no change on the part of our elected officials, on the top
policy choices, on free trade, on outsourcing, and focusing on
manufacturing, how to incentivize it and how to build our
middle class, rather than destroy it, this administration will
be remembered for something besides change and a disbelief in
the change they brought, but rather the legacy will be further
destruction of this economy, and that is intolerable to all of
us. Bill Tucker, thank you very much.

The High-Tech Hindu Nationals bought a foreclosed home at a “good deal” , profiting once again at American’s expense.
The Male Hindu National works in the huge High Tech industry around Chandler, Arizona ,where importing foreign workers , rather then hiring American college grads , is the norm.
cable tv is brazen , openly showing illegal aliens employed , with all the blandness of Wonder Bread.

I am furious that these jobs are being given to foreign workers, and Corrupt Congress continues to give away good jobs to foreign workers , while our own college grads struggle to pay off student loans at 1980 wages.

HGTV – the Home and Garden station, featured a family of Hindu Nationals , complete with two anchor babies.

It was so nice to see them discuss how happy they were that the neighbors kept up their yards.

I’ve never worked with them but from what I hear, they’re a typical body shop that brings in loads of foreign workers on H1-B visa from India and other 3rd world dumps and floods the IT market with them. Then, people like me with 10+ years in the IT industry who truly know their stuff have to clean up the mess they leave behind.

Sen. Menendez’s plan to bring in an additional 550,000 permanent foreign workers next year would be made worse by chain migration. Every one of the proposed 550,000 immigrants under Sen. Menendez’s plan would create a chain of immigrants connecting to more than a dozen other families. Once you do the math, you can see how devastating Sen. Menendez’s plan would be for American workers and the infrastructure of our country.

First, a typical immigrant from a developing nation has three adult siblings from one family. As soon as that immigrant becomes a citizen, he or she can put those siblings in line for immigration. In other words, as soon as that first immigrant arrives, the rest of the extended family considers themselves on a path to America as well. However, the chain does not end there.

The first immigrant’s spouse plus the spouses of the first immigrant’s adult siblings are also eligible. That makes nearly half a dozen families who are waiting in line thanks to that one (just one of 550,000) immigrant. Each family includes siblings, minor children, parents, etc.

In addition, each of those spouses has adult siblings, and the chain continues. A single immigrant can create a chain of possibly 17 different families. The chain migration effect on Sen. Menendez’s proposal has been missing from the discussion. At the very least, I hope you will oppose Sen. Menendez’s plan. Should you feel compelled to do something proactive, you could also introduce a bill to end chain migration, which clearly does not benefit the interests of the United States.

(Nasdaq:AAPL) are turning to cross-cultural training and English second language courses in order to help foreign-born employees adapt to American work-life, as well as build multinational corporate cultures.
Of all the high-tech companies, Intel has one of the most impressive programs — running a perpetual cross-cultural training program out of Chandler, Ariz.
“We are a 24-hour factory. We are 24-7,” said Nancy Kenney, Intel’s multicultural program manager.
As Kenney spoke, the Chandler campuses were training 70 Intel employees flown in from the company’s Costa Rica assembly testing facility. “At all times there are people [undergoing cross-cultural training] from Costa Rica, Israel, Malaysia, the Philippines and Ireland,” she said. Kenney said a key aim of training was to instill Intel’s corporate culture and way of doing business.
After all, when you have a veritable United Nations of employees working in telecommuting teams, it helps if they have a common approach.
“Intel has its basic culture and values which everyone learns, whether they are in the United States or Costa Rica or Malaysia,” she said.

  • His Indian Brother has a company in the US and he hired his Indian relative. More exclusionary behavior and absolutely typical of immigrants; legal or otherwise.
  • He assumes he has the right to stay in the US permanently , even though an Hi-b worker is a temp worker.
  • He wants to help the poor of India , therefore he needs to go home because he is completely ethno -nationalistic and would make a Horrible American.
  • His father says stay in the US because India is corrupt. Well, the US is corrupt now too., with all the immigrants running scams here, completely oblivious to US Laws or customs.
  • Epic Systems in Madison Wisconsin is considering hiring him over an American, suggest everyone send them an email and put a stop to this.

Summer house, India/US dilemma and my Dreams
I and my roomies moved to a new apartment for the summer. Just for two months. And the reason I am writing this is because there has been drastic change in the way things happen here, even though the people remain the same. We now do not keep spoiled utensils over-night, in fact we wash it as soon as we are done with them. We are six guys living here. And now we have turns to make dinner. One day each person, alone makes dinner for all 6 guys. My turn is on Wednesday. I chose Wednesday because I was born on Wednesday. Till now I have made Kadhi. It wasn’t a hit because kadhi ‘faat gai’…hehe….But tomorrow (or should I say today!) I am going to make ‘maag nu saak’. I called mummy to ask how much to soak. I hope I get the quantity right. Its ok if there is more. I will take it to lunch at work on Thursday. I spend a lot eating outside for lunch. Consider 20 working days in a week. Then on avg if you say $5 then its $100 a month and weekends and dinner at nights separate. So may be if I can take my lunch to office even twice a week then it would be nice. Also I am bored of eating same thing again and again at outside fast food restaurants. The places I can go are Chipotle, Subway, Burger King, Café 84, Taste of India and Thai food. Actually its quite a many options. Anyways….In fall semester I was so fed up of eating outside that in a break of 1 hr between my class and job, I went home cooked food and came back to work. About my career, I have a H1-B visa, sponsored by my cousin Amrish’s friend’s company. But I am also looking for another job. If it get it before I graduate (i.e. before Aug) then I will join that company and try to figure out my options with the company that sponsored my visa. I have had quite a number of calls for full time but I haven’t been able to convert it. I have one onsite interview next week at Madison, Wisconsin at Epic Systems. So let’s see how it goes.I am not yet sure whether I want to live here in US or go back to India. Dad says I should live here because its very tough to do business in India because of corruption and bureaucracy. You cannot get anything done easily. That’s true but in the end it is INDIA. I think without a nice group of friends and/or relatives near you, it’s very boring to live in US. But lets see what destiny holds for me. Once I start doing full time job I will have a better idea of what I want to do. But in the end I want to do a business of my own, no matter a small one. I, my dad and my brother Harit have the same opinion about it. So I feel encouraged. Also I personally feel that doing a job for the whole life in US is so boring and unrewarding in terms of social life. But……From my past experiences, I have learnt that you should not plan to much…or at least not think too much about it and feel that it would work out the same way you want to…. so I am ready to accept what ever comes to me….and only time will tell….Lets talk about my dreams….I had two dreams…,rather three…. I say HAD because one of them is crushed, badly crushed. But that’s the most beautiful ‘experience’ in my life. The other is going on or it’s completed. It was coming to the US. The third hasn’t started yet. And I don’t know when it would start, but I want that dream to realize, no matter how late in my life. And that dream is…………. It’s helping the poor and needy in every possible way….a roof above their head, education, make them independent…. ………give them a reason to live….to smile… I want to help in terms of money, my services and set up a whole network for it… I wish to do that for my fellow Indians. But I believe that to help others, you should be independent first. So it will take some time for me to become ‘independent’

US Engineer tells Obama to deal with H1-b Visa abuse Most H1-b visa workers come from India and employed in high-tech jobs, not all, but a lot. New information has come out that India , China, Laos and Iran refuse to accept any their citizens back that the US tries to Deport. This means that Every H1-b Worker from those countries are here permananently and are not temp workers . Indian Nationals are one of the largest groups of Illegal aliens in the US and have the highest income level. They are job theives and crooks pure and simple, and the funny thing is with their caste system they consider Americans to be inferior to them.

H1-B Visa Problem that Obama/Biden should solve!

BTW, I am an Obama/Biden supporter. But, so far in this election campaign neither parties Republicans or Democrats have talked and dealt directly with the H1-B Visa topic and how it is totally out of control. The abuse of it, will lead to declining wage for US High Tech workers as well as declining in Engineering programs enrollment national wide. Like many issues about the economy that the Republicans are out of touch with Middle Class America, H1-B Visa is a real issue for educated Americans who are in the technology industry. If Obama/Biden does not recognize this in the next 60 days and raise it as an issue that you are willing to directly deal with, I afraid it will not do much for us Middle Class technology workers. There is a huge abuse of the H1-B Visa program by the candidates themselves as well as by the employers. Something has got to be done about this, as the unemployment numbers are going up and the living standards and jobs for local citizens are slowly vanishing away. This in the long run will lead to brain drains and an irreversible problem if not stopped immediately. You need to deal with this H1-B Abuse issue in the upcoming debates and offer a planned proposal and speak on how you are going to deal with it directly and solve it: 1. Stop giving Tax incentives to corporations who are offshoring/outsourcing jobs. 2. For every H1-B visa hired, show proof that a local citizen has been offered the same job and declined to prove that the shortage is legitimate. This has to be within 2 months of hiring an H1-B. If the document is older than 2 months, it is invalid. 3. Crack down on people who are overstaying their H1-B or jumping ship to another company that is willing to sponsor their H1-B from their original hired company. 4. If Unemployment is over 3%, freeze all H1-B visas that are currently in the application process and start to reduce the cap on the number of granted H1-B visas. 5. Track the numbers of all H1-B Visas and the actual figures in aggregate Dollars that we are reducing the wealth of the US economy by. Publish this figures to all. We need to see these figures as a metrics. Without metrics, without identifying problems, we can’t solve them… 6. Total revised comprehensive H1-B visa/guest worker program to stop any kind of abuse by the employers or the hired H1-B guests via any kind of loopholes via INS rules. There are many loopholes at this point in time that are being explored by these guess workers to abuse and overstay their visas to the point where they are granted GREEN cards and eventually become US Citizens… This figure is not just 1, but by the hundreds of thousands. Look at the census number for the figures of certain group of people here since 1990s to the present time. If Obama/Biden are able to bring up this specific issue and how you specifically will solve it. You will definitely have an edge over the Republicans in these last, but most important 60 days before the election. So far you are winning, but the race is very close, so you need to differentiate yourself, provide more ammunition for Middle Class America being able to see what you can do to protect the economy, the livelihood of US Technology workers who are Citizens of the US from H1-B abuses. Democrats will win this election if the above happens.
Great Education should secure a great job. That used to be true until the exploitation and abuses of H1-B Visas.
